Unite Legal Services wins unfair dismissal claim against easyJet

A Unite member was found to have been unfairly dismissed when easyJet wrongly accused her of theft. The Unite member was the cabin crew manager of a flight on which other members of staff had already resigned in response to the accusation. Despite this, easyJet charged our member with gross misconduct. There was no evidence to suggest that she had done anything wrong, other than the fact that the member was present on the flight.

After looking at the evidence in detail, a solicitor from Unite Legal Services found that easyJet was “simply not reasonable in coming to the conclusion that the member was involved in any misconduct”.

Despite this our solicitor stated easyJet was still “bullish in the way they approached the case” and as no reasonable solution was proposed the case proceeded to a full Tribunal hearing. The Tribunal found that the member had been unfairly dismissed and ordered that our member be compensated.

Peter Kavanagh, Unite regional secretary commented “It is crucial that when employers act unreasonably, often with grave consequences for members, they know Unite will act to protect our member’s best interests and can call upon the expert support of Unite Legal Services.”
