How long will personal data be retained:-
The data collected on this register will be kept on record until it is no longer required for any possible future legal case.
Unite cannot currently give a fixed period for how long it will be necessary to keep your Silica Dust register entry, as certain medical conditions/personal injuries can take years to present. Retention of personal data on the Silica Dust register will be periodically reviewed by Unite’s in-house personal injury solicitor and, if/when records are no longer needed, personal data will be deleted.
What types of personal data will be collected and used:-
- Name (to identity you)
- Home address and email address (toestablisha method of tracing you in the future)
- Employer details (to identity you as a potential witness to a claim involving the employer)
- Details of yourSilica Dustexposure and surrounding circumstances (to provide a contemporaneous record)

- Trade Union membership (to identity you and your membership record if further contact details arerequired)
- Medical information (to provide a contemporaneous record anddetermineany immediate or long-term symptoms which might be related to exposure to Silica Dust
Legal basis for processing the information: -
The processing of this data is to provide a digital record of your exposure to Silica Dust, which when exposed to over time can cause serious respiratory diseases and fatal illnesses, for use in bringing or supporting potential personal injury claims in the future and/or for providing evidence of exposure to employers and Government bodies.
Unite relies on consent and/or legitimate interests as the lawful basis for processing the data collected on this form. In relation to special category data (trade union membership and health (medical) information), Unite relies on express consent and/or the establishment of legal claims conditions to share data with panel law firms and/or the not-for profit bodies (trade union) condition to process information within the union.
Who will have access to your personal data
We may disclose information about you to Unite’s panel law firms, officers, staff, branch officials, workplace representatives or agents, insofar as reasonably necessary for the purposes as set out in this policy. Unite may also disclose anonymised statistical data derived from the entries for the purposes of campaigning to improve health and safety both within the workplace and in general.
Your right to withdraw consent
You have the right to withdraw your consent to Unite sharing your data with panel law firms for the purpose of assisting personal injury claims at any time and the processing of your data prior to withdrawal remains lawful. If you wish to withdraw consent, you should send an email to dataprotection@unitetheunion.org marked “Silica Dust register consent withdrawal”.
